Terms and Conditions of Sale
GENERAL TERMS AND CONDITIONS OF SALE
Last updated: 13 October 2026
These general terms and conditions of sale (hereinafter the “General Terms and Conditions of Sale”) govern the offer and sale of goods on this website, www.addicted-to.com (hereinafter the “Website”).
Goods purchased on the Website (hereinafter the “Products”) are sold directly by COSTA CALDURA S.R.L., with its registered office at Via Vincenzo Cavallaro 13 – 90015 Cefalù (PA), Italy, VAT No. IT06497310828, email info@addicted-to.com, tel. 339 627 4001 (hereinafter referred to as the “Seller”).
In order to place a purchase order, you must read and accept these General Terms and Conditions of Sale. Failure to accept the General Terms and Conditions of Sale will mean that you will be unable to make purchases on the Website.
1. INTRODUCTION
1.1 These General Terms and Conditions of Sale govern exclusively the offering, submission and acceptance of purchase orders for the Products on the Website between the Seller and users of the Website.
1.2 Through the Website, the Seller offers the Products for sale and conducts its e-commerce business exclusively with its end users who are of legal age and “consumers”, that is to say, natural persons acting for purposes unrelated to any commercial, business, craft or professional activity they may carry out (hereinafter the “Customer”).
1.3 The Seller dispatches Products to the following countries: all Member States of the European Union, Switzerland, the United Kingdom and the United States of America (hereinafter the “Countries of dispatch”). The Seller reserves the right not to fulfil orders placed by parties other than “consumers” and/or minors, or where the delivery address is outside the Shipping Countries. For shipments to countries outside the European Union, duties, taxes and customs charges may be payable by the Customer, in accordance with the legislation of the country of destination.
1.4 The General Terms and Conditions of Sale do not govern the sale of goods or the provision of services by parties other than the Seller, even where such parties are featured on the Website via links, banners or other forms of reference. It is the Customer’s responsibility to check the terms and conditions of sale before placing orders and purchasing goods and services from parties other than the Seller. The Seller is therefore not liable for the sale of goods and/or the provision of services by third parties and/or for the conclusion of agreements between the Customer and such third parties.
2. PURCHASE ORDER FOR PRODUCTS
2.1 To purchase one or more Products on the Website, the Customer must select the Products they wish to purchase and add them to their basket. Once the selection is complete, the Customer proceeds to checkout, enters the required details, chooses the payment method and confirms the order by clicking on the ‘Place Order’ button. In the case of payment by bank transfer, the Customer will receive the bank details in the order confirmation and must make the payment via their bank.
2.2 The language available for the conclusion of the contract is Italian. Any translations of the Website are provided as a courtesy.
2.3 The order form contains a reference to the General Terms and Conditions of Sale, as well as a summary of the main features of each Product ordered and its price (including all applicable taxes or duties), the accepted methods of payment and the delivery arrangements for the Products purchased, the postage and delivery charges, the conditions for exercising the right of withdrawal, and the procedures and timeframes for returning the Products purchased.
2.4 Before proceeding with the purchase of the Products by submitting the order form, the Customer must read the General Terms and Conditions of Sale carefully; they may also print, save or make a copy of them for personal use. By submitting the order form, the Customer declares that they have understood and approved the contents of the form itself, and that they have accepted the General Terms and Conditions of Sale; failing this, the purchase order cannot be processed.
2.5 Before submitting the purchase order form, the Customer may check the order details and identify and correct any errors in the data entered.
2.6 By submitting the order form, the Customer undertakes to pay the price stated in the order.
2.7 Once the purchase order has been accepted, the Seller shall send the Customer, by email, a confirmation of the purchase order, which shall include the General Terms and Conditions of Sale or a link to them, information regarding the essential characteristics of the Products and a detailed breakdown of the price (including all applicable taxes or duties), the payment methods, the conditions and procedures for exercising the right of withdrawal, and the delivery costs. The contract shall be deemed to have been concluded upon dispatch of this confirmation.
2.8 The Seller reserves the right not to accept purchase orders that are incomplete or incorrect, that do not provide sufficient guarantees of solvency, or where the Products are unavailable. In such cases, the Seller shall promptly, and in any event within 14 days from the day following that on which the order was submitted, inform the Customer by email that the contract has not been concluded and that the Seller has not processed the purchase order. Should the Customer have already paid the price, the Seller shall refund the full amount paid.
2.9 The order form will be stored in the Seller’s database for as long as is necessary to process the orders and, in any event, in accordance with the law.
2.10 Only genuine products selected or manufactured by Addicted To Nature are offered for sale on the Website.
2.11 The key features of the Products are set out on the Website within each Product description. However, the images and colours of the Products offered for sale may not correspond exactly to the actual items due to the internet browser and/or monitor used.
2.12 Where present, the Product’s identification tag forms an integral part of it.
3. PRICES AND PAYMENTS
3.1 The prices of the Products shown on the Website are quoted in euros (€) and include VAT. They do not include postage and delivery charges, which are clearly stated before the order is confirmed.
3.2 Product prices may be subject to change. The price shown on the Website at the time the order is placed shall apply to the Customer.
3.3 The following payment methods are accepted:
- credit and debit cards (via Stripe);
- Apple Pay and Google Pay;
- PayPal;
- bank transfer in advance.
3.4 In the case of payment by card, Apple Pay, Google Pay or PayPal, the price of the Products and the delivery charges will be charged when the order is placed. In the case of a bank transfer, the order will be processed once the payment has been credited; should payment not be received within a reasonable period, the Seller may cancel the order by notifying the Customer.
3.5 Payment card details are entered and processed directly by the payment service providers via an encrypted protocol, without the Seller or any third parties having access to them. The Seller does not store such data.
4. PRODUCT AVAILABILITY
4.1 Product availability refers to actual availability at the time the Customer places the order. However, this availability should be regarded as indicative only, as, due to the simultaneous presence of multiple users on the Website, the Products may be sold to other customers before the order is confirmed.
4.2 If, even after the order confirmation has been sent, a Product proves to be wholly or partly unavailable, the Seller shall promptly inform the Customer of this by email. The Customer may choose either to receive the available Products or to cancel the order; in either case, the amount corresponding to the unavailable Products will be refunded without undue delay and in any event within 14 days.
4.3 If the Customer requests the cancellation of the order by terminating the contract in accordance with clause 4.2, the Seller shall refund the amount within 14 days of becoming aware of that decision.
5. DELIVERY OF PRODUCTS
5.1 Products ordered on the Website are delivered by courier to the address specified by the Customer in the countries to which they are shipped. The costs, methods and delivery times are set out in the order form and form an integral part of the General Terms and Conditions of Sale.
5.2 Delivery is entrusted to couriers on the basis of the lowest cost or the greatest speed or security, taking the destination into account.
5.3 The delivery times indicated on the Website refer to working days, excluding public holidays. Unless otherwise agreed, the Products shall be delivered within 30 days of the conclusion of the contract (Article 61 of the Consumer Code). In the event of failure to deliver within this period, the Customer may request the Seller to make delivery within a reasonable additional period and, in the event of further non-performance, terminate the contract and obtain a refund of the amount paid.
5.4 Upon delivery, the Customer is asked to check that the packaging is intact and to report any damage to the courier and the Seller. This does not affect the Customer’s rights under the statutory guarantee of conformity.
6. TRANSFER OF RISK AND TITLE
6.1 The risk of loss or damage to the Products passes to the Customer at the moment when the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of the Products. Ownership of the Products passes to the Customer upon delivery, provided that the full price, including delivery charges, has been paid.
7. RIGHT OF WITHDRAWAL
Exercising the right of withdrawal
7.1 The Customer has the right to withdraw from the contract concluded with the Seller, without having to give any reason and without incurring any penalty, within 14 days from the day on which the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of the Products. In the case of an order for multiple Products delivered separately, the period begins on the date of delivery of the last Product.
7.2 To exercise the right of withdrawal, the Customer must notify the Seller, before the expiry of the time limit, of their decision to withdraw by means of an explicit statement, using one of the following methods:
- online cancellation function: in your personal account, under the “My Account” > “Orders” section, by selecting the relevant order and the ‘Request a return/cancellation’ option. Once the request has been submitted, the system records its receipt, makes it available for viewing in your personal account, and the Seller sends confirmation on a durable medium (email) without delay;
- email at the following address info@addicted-to.com, stating their first name, surname, address, email address, order number and date, date of receipt and the Products subject to the withdrawal. The Customer may use, though is not obliged to do so, the standard withdrawal form set out at the end of these Terms and Conditions;
- post at the address COSTA CALDURA S.R.L., Via Vincenzo Cavallaro 13 – 90015 Cefalù (PA).
A Customer who has made a purchase without registering may exercise their right of withdrawal by email or post. The burden of proof regarding the correct exercise of the right of withdrawal rests with the Customer.
7.3 If the right of withdrawal is exercised, it is not possible to replace the Product directly with another one; to purchase a new Product, the Customer must place a new order.
7.4 The Customer shall only be liable for any reduction in the value of the Products resulting from handling them in a manner other than that necessary to ascertain their nature, characteristics and functioning.
7.5 It is recommended that Products be returned complete with any tags, accessories and labels. Should the Products be returned without tags, showing signs of use or otherwise damaged, the right of withdrawal remains unaffected, but the Seller may deduct from the refund an amount corresponding to the reduction in value in accordance with clause 7.4.
7.6 The right of withdrawal is excluded, in accordance with Article 59 of the Consumer Code, in the following cases:
- Products made to measure or clearly personalised at the Customer’s request;
- Products that are likely to spoil or go off quickly (e.g. fresh food);
- Sealed products which cannot be returned for hygiene or health protection reasons (e.g. cosmetics) and which have been opened after delivery;
- Goods which, following delivery, are, by their very nature, inseparably mixed with other goods.
Return times and procedures
7.7 The Customer must return the Products without undue delay and, in any event, within 14 days of the date on which they notified their withdrawal, by posting them to the following address: COSTA CALDURA S.R.L., Via Vincenzo Cavallaro 13 – 90015 Cefalù (PA). The deadline is deemed to have been met if the Customer posts the Products back before the end of the 14-day period.
7.8 The direct costs of returning the Products shall be borne by the Customer. Where possible, it is recommended that the Products be returned in the original packaging supplied by the Seller.
Refund times and procedures
7.9 The Seller shall refund all payments received from the Customer, including standard delivery charges (excluding any additional costs arising from the choice of a delivery method other than the cheapest standard delivery option offered), without undue delay and in any event within 14 days of the date on which the Seller was notified of the withdrawal.
7.10 The refund will be made using the same payment method used by the Customer for the original purchase, unless the Customer has expressly agreed otherwise; in any event, the Customer shall not incur any costs as a result of the refund.
7.11 The Seller may withhold the refund until the Products have been received or until the Customer has provided proof that the Products have been returned, whichever is earlier.
7.12 Where the recipient of the Products is not the same person as the payer, the refund will be made to the payer, unless otherwise agreed.
7.13 If notice of withdrawal is given after the prescribed deadline or relates to Products excluded under clause 7.6, the Customer shall not be entitled to a refund; however, they may, at their own expense, reclaim any Products that have already been returned.
8. STATUTORY GUARANTEE OF CONFORMITY
8.1 The Seller shall be liable to the Customer for any lack of conformity in the Products existing at the time of delivery and which becomes apparent within 2 years of such delivery, in accordance with Articles 128 et seq. of the Consumer Code (Legislative Decree 206/2005, as amended by Legislative Decree 170/2021).
8.2 Unless the contrary is proved, it is presumed that any lack of conformity which becomes apparent within one year of delivery already existed at that time, unless such a presumption is incompatible with the nature of the Product or the defect.
8.3 The Customer forfeits their rights if they do not report the defect to the Seller within 2 months of the date on which they discovered it. In any event, the right to bring a claim expires 26 months after delivery of the Product.
8.4 In the event of a lack of conformity, the Customer is entitled, at their discretion, to have the Product brought into conformity by means of repair or replacement, free of charge, unless the chosen remedy is impossible or would entail disproportionate costs for the Seller. The Customer is also entitled to a proportionate reduction in price or to terminate the contract in the cases provided for in Article 135-bis of the Consumer Code, for example where the Seller has failed to carry out the repair or replacement, the defect persists or is so serious as to justify an immediate price reduction or termination.
8.5 To make a claim under the warranty, the Customer may contact the Seller at the following address info@addicted-to.com, attaching proof of purchase (e.g. the order confirmation).
9. PRIVACY
9.1 The Customer’s personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR), as set out in the Privacy Policy.
10. GOVERNING LAW AND SETTLEMENT OF DISPUTES
10.1 The General Terms and Conditions of Sale are governed by Italian law, in particular by Legislative Decree No. 206 of 6 September 2005 (“Consumer Code”), with specific reference to the provisions governing distance contracts, and by Legislative Decree No. 70 of 9 April 2003 on electronic commerce. This is without prejudice to the application of any more favourable mandatory provisions of the law of the Customer’s country of habitual residence.
10.2 Any dispute relating to the application, performance and interpretation of these Terms shall be subject to the jurisdiction of the court of the place of residence or domicile of the Customer, provided that such place is situated within the territory of Italy.
10.3 The Customer may first contact the Seller’s customer service department to seek an amicable resolution. The Customer may also make use of the alternative dispute resolution (ADR) procedures provided for in Articles 141 et seq. of the Consumer Code, without prejudice to the right to bring the matter before the courts.
11. AMENDMENTS TO THE GENERAL TERMS AND CONDITIONS OF SALE
11.1 The General Terms and Conditions of Sale may be amended by the Seller at any time, including in response to changes in legislation. The new Terms and Conditions shall take effect from the date of publication on the Website.
11.2 The General Terms and Conditions of Sale in force on the date the purchase order is placed shall apply to each contract.
